Consignment agreement, dispute resolution, and chargeback policies

Consignment Agreement

By submitting items to Cleveland Cardz, you warrant that you are the sole, lawful owner of all submitted property, free and clear of all liens, claims, encumbrances, or security interests. You possess full legal authority to consign and authorize the sale of said items by Cleveland Cardz, LLC. Legal title to consigned property remains with you until full payment is received from a buyer and the sale transaction is finalized. Cleveland Cardz acts solely as an independent marketing agent and bailee. Note: Once an auction listing receives a bid, the sale becomes legally binding — the item cannot be withdrawn or cancelled and will sell to the highest bidder.

Commission & Fee Schedule

  • Commission (flat rate): 8% of final sale price
  • Express processing (optional): $2/item · due at submission
  • Reserve price fee (eBay, optional): $5 due at submission · remainder deducted from payout
  • Item withdrawal fee (optional): $0.50 per card · $1 per other item · only after processing/listing
  • Consignment extension fee (optional): $5/batch · covers storage & handling
  • eBay Final Value Fee: 13.25% for items $7,500 and under, 2.35% over $7,500, plus $0.30/order — deducted from payout
  • CollX FVF (BIN items): $8% · items sold on CollX marketplace
  • CC Merchant Processing Fee: $4.3% · items sold on clevelandcardz.com (credit card processing fee)

The only payment due at submission is the $5 eBay Reserve Fee (if you set a reserve) and any optional express processing fee. eBay's final value fee, the eBay Reserve Fee remainder, shipping, and promotional costs are all deducted from the gross sale before payout — nothing else is due upfront. Every fee marked optional is a choice: decline all of them and you are charged nothing beyond the flat commission and the marketplace fees on the sale.

Accepted Items — Must Meet All Criteria

  • Single Card: No factory-sealed boxes, packs, or sets. Multi-piece cards will be separated and processed individually unless still sealed.
  • Licensed: Must be officially licensed by the league, team, or player's association. No unlicensed cards, art cards, or sketch cards (including custom artwork and unlicensed sketch cards).
  • Authentic: Reprints must be clearly labeled. Heavily counterfeited cards may require professional grading. Cards declined by major grading companies may not be accepted. Backdoored cards — cards stolen from production facilities that were never legally released to the market — are strictly prohibited.
  • Autograph Authentication: Autographed memorabilia must be accompanied by a COA from a reputable third-party authentication service (PSA/DNA, JSA, Beckett/BAS, etc.). Manufacturer-authenticated autograph inserts are exempt. If you have a question regarding if an authentication/grading company is acceptable, please reach out to us at customersupport@clevelandcardz.com.
  • Family-Friendly: All items must be appropriate for general audiences — no explicit, offensive, or adult content.
  • Sellable Condition: We accept cards in all grades. Altered vintage cards will be noted as such, but altered modern cards (1981+) are not accepted.

Right to Refuse Items

Cleveland Cardz, LLC reserves the right to refuse any submitted item at our sole discretion, without providing a reason. This includes items that do not meet our acceptance criteria, items we determine are not suitable for sale, or items received in a condition materially different from what was described at submission. Refused items will be returned to the consignor, and the consignor is responsible for all return shipping costs. Payment for return shipping must be arranged before items are shipped back.

Authenticity Warranty

You warrant the complete authenticity of all items (not counterfeit, forged, altered, recolored, trimmed, re-backed, or resealed). If any sold item is determined non-authentic by an authorized grading/authenticating service (PSA, BGS, CGC, SGC, Beckett) or returned by a buyer on verified authenticity grounds, you shall immediately reimburse Cleveland Cardz for the full refund amount, marketplace selling fees, and return shipping costs within 10 calendar days of written demand.

Dispute Resolution Timelines

Net proceeds will be disbursed only after the standard buyer return and dispute window has lapsed:
  • Sports cards: 3 days after sale
  • All other items (memorabilia, comics, Funko Pops): 30 days after sale
If a transaction fails due to non-payment or buyer return, the item remains your property and will be relisted or returned at your request.

Chargeback Reimbursement

If a buyer files a chargeback, you (the consignor) are responsible for reimbursing Cleveland Cardz within 10 business days of notification. This includes the full chargeback amount, chargeback fees, and any associated return shipping costs. Failure to reimburse may result in withholding of future payouts until the balance is settled.

Negative Balance Carry-Forward

Auction outcomes are unpredictable, and occasionally the combined marketplace fees and commissions on an item may exceed its sale price, resulting in a negative net payout. In such cases, the negative balance is carried forward on your account and automatically deducted from future payouts. For example, if an item settles at -$4.49 and your next item settles at +$200, your next payout will be $195.51. This ensures Cleveland Cardz is made whole for costs incurred on underperforming auctions while still maximizing returns on better-performing items. By submitting items for consignment, you authorize this carry-forward offset.

Auction Irrevocability

For items designated for public auction, you expressly covenant that auction listings cannot be cancelled, withdrawn, or modified once an active bid has been placed, or during the final 24 hours of the scheduled auction period. Once an auction enters either condition, the listing shall proceed to conclusion and you are legally bound to honor the sale. Title to the item remains with you until full payment is received from the buyer, as provided in Section 3 (Title Retention & Agency Status), at which point the sale is finalized and the item ships to the prevailing highest bidder.

Pricing, Listing Formats & Markdown Discretion

Items will be marketed via public auction or fixed price ("Buy it Now" / Storefront) based on agreed schedule. If no reserve is set on the manifest, Cleveland Cardz retains full discretion to list at market starting bids. After 45 days of non-sale on fixed listings, Cleveland Cardz reserves the right to discount price by up to 15% unless a firm floor price is documented.

Buy it Now (BIN) Multi-Marketplace Listing: BIN items are listed across 3 marketplaces — clevelandcardz.com, CollX, and eBay — to maximize exposure and sales velocity. CollX charges an 8% Final Value Fee for items sold on their platform, deducted from your payout. eBay's final value fee (13.25% / 2.35%) applies to items sold on eBay. A 4.3% merchant processing fee applies to items sold directly on clevelandcardz.com (credit card processing fee, not charged by Cleveland Cardz).

Unsold Items & Abandonment

The consignment term is 90 days. Unsold items may be reclaimed upon paying return shipping/handling. A $2 per-item withdrawal fee applies to items pulled after they have been processed or listed but before the consignment term ends, to cover photography, listing, and handling costs. If you fail to claim or pay return shipping within 30 days after formal expiration notice, the property is deemed legally abandoned and Cleveland Cardz may liquidate or dispose of items to recover handling/storage fees.

Carry-Forward Balances & Unclaimed Property

Payout balances below the minimum payout threshold may be carried forward to the next payout cycle. Carry-forward balances must be claimed within 12 months of the original sale date. After 12 months, Cleveland Cardz, LLC will notify the Consignor to arrange payout or collection within 30 days. If the balance remains unclaimed after this 30-day period, it may be remitted to the Georgia Department of Revenue as unclaimed property pursuant to O.C.G.A. § 44-12-190 et seq. Consignors are responsible for keeping their contact and payout information current to ensure timely delivery of funds.

Lost in Transit & Insurance Reimbursement

If an item is lost in transit to our facility, the consignor is responsible for filing a claim with their shipping carrier. Cleveland Cardz is not liable for carrier loss during incoming transit.

If an item is lost in transit to a buyer after sale, Cleveland Cardz will reimburse the consignor for the lost item at the net payout amount. However, reimbursement is subject to a 45-day grace period to allow Cleveland Cardz to file, process, and receive payment from insurance claims with the shipping carrier. If the insurance claim is approved and paid within the grace period, the consignor will be reimbursed within 10 business days of claim settlement. If the claim is denied or remains unresolved after 45 days, Cleveland Cardz will reimburse the consignor regardless, minus any applicable insurance deductible. The consignor agrees to cooperate with Cleveland Cardz in providing any information needed to file or support an insurance claim.

Account Closure & Deletion Requests

You may request closure of your account at any time from Account Settings. A deletion request is a request only; it does not terminate, suspend, or otherwise affect any consignment arrangement then in effect, and it does not release you from any obligation under these Terms.

Condition precedent to account closure. As an express condition of account deletion, you must first: (a) withdraw from Cleveland Cardz's possession every item consigned under that account, whether listed, unlisted, unsold, returned, or awaiting processing; (b) pay all withdrawal fees, return shipping and handling charges, consignment extension fees, storage charges, chargeback reimbursements, carried-forward negative balances, and any other amounts then due under these Terms; and (c) satisfy any outstanding invoice issued to your account. Cleveland Cardz will not close, delete, or release an account while any consigned property remains in its custody or any such amount remains unpaid.

Until every item has been withdrawn and all amounts settled, the consignment term, fee schedule, storage, and abandonment provisions of these Terms continue to apply in full, and the request remains pending. Cleveland Cardz retains a continuing lien on consigned property in its possession for any amounts owed by you, and may withhold return of that property until those amounts are paid.

Once all items have been withdrawn and all amounts settled, account closure will be completed within thirty (30) days of the request. Cleveland Cardz may retain transaction, payout, tax, and dispute records as required by applicable law or as reasonably necessary to enforce these Terms, even after the account is closed.

Updates to These Terms

Cleveland Cardz, LLC reserves the right to modify, update, or amend these Terms of Service at any time, with or without prior notice. Any changes become effective immediately upon posting the revised terms to this page. It is your responsibility to review these terms periodically. Your continued consignment of items, or failure to request return of unsold items, after any such changes constitutes your acceptance of the updated terms. If you do not agree with the revised terms, you may discontinue submitting new items and request the return of any unsold items in accordance with the return shipping provisions outlined above.

Limitation of Liability

Cleveland Cardz stores consigned goods with standard professional care in secure facilities. Our liability for loss, theft, fire, or accidental damage while in physical possession is capped at fair market wholesale liquidation value (or 70% of 30-day average verified comp value), not subjective sentimental or replacement cost. We are not liable for carrier damage during incoming transit.

These terms constitute the entire agreement between you and Cleveland Cardz, LLC. By submitting items for consignment, you acknowledge that you have read, understood, and agreed to all terms outlined above.
